Steps for obtaining a legal Heir Certificate

  • Self-undertaking Affidavit
  • Photocopy of the death certificate of the expired person
  • Address proof of the expired person. You can give the photocopy of any one of the following – Voter ID Card, Adhar card, PAN Card, Driving License, or Passport.

Under the Indian laws, the following people are allowed to be the legal heirs of an expired person, who can receive a legal heir certificate in India- a spouse of the deceased, son of the deceased, daughter of the deceased, mother of the deceased and father of the deceased.

In case of any controversy between the heirs of the deceased, a legal heir certificate is not enough, you need to consult a Family Lawyer and approach a civil court to get an appropriate certificate for the determination of the rightful heirs.
